1. INTRODUCTION AND ACCEPTANCE

1.1 These Terms and Conditions ("Terms") govern the use of the website https://safari-tz.com/ ("Website") and all safari tours, travel packages, bookings, enquiries, and related services provided by Safari-tz.com("Safari-tz," "the Company," "we," or "us").

1.2 By accessing this Website, submitting an enquiry, paying a deposit, or confirming a booking, the Client acknowledges having read, understood, and agreed to be legally bound by these Terms.

1.3 Where a booking is made on behalf of multiple travellers, the person making the booking warrants that they have authority to accept these Terms on behalf of all persons included in the booking and accepts financial responsibility for the entire booking.

2. DEFINITIONS

2.1 "Company" means Safari-tz.com, duly registered in the United Republic of Tanzania.

2.2 "Client" means any individual, entity, or Group Leader using the Website or booking Services.

2.3 "Website" means https://safari-tz.com/ and all associated domains or subdomains.

2.4 "Services" means safari tours, wildlife experiences, Mount Kilimanjaro treks, Zanzibar holidays, accommodation bookings, transfers, flights, excursions, and related travel services arranged by the Company.

2.5 "Supplier" means any third-party provider including lodges, camps, hotels, airlines, national park authorities, transport providers, guides, and activity operators.

2.6 "Force Majeure" means any event beyond the reasonable control of the Company, including but not limited to natural disasters, epidemics, pandemics, airline failures, political unrest, strikes, extreme weather, acts of government, or war.

2.7 "Booking" means the confirmed arrangement as detailed in the written confirmation issued by the Company.

3. USE OF THE WEBSITE

3.1 The Website is provided for informational and booking purposes relating to Tanzania safaris and associated travel services.

3.2 The Client may view and print Website content for personal, non-commercial use only.

3.3 The Client shall not reproduce, distribute, modify, commercially exploit, scrape, copy, or otherwise misuse any content on the Website without prior written consent of the Company.

3.4 The Client shall not attempt unauthorised access, introduce malicious software, or engage in unlawful or fraudulent conduct through the Website.

3.5 The Company reserves the right to restrict or terminate Website access where misuse is identified.

4. BOOKING PROCESS AND CONTRACT FORMATION

4.1 All quotations are provided subject to availability and are not binding until confirmed in writing.

4.2 A contract between the Company and the Client shall arise only upon receipt of the required deposit and issuance of written confirmation by the Company.

4.3 The Company reserves the right to decline any booking prior to confirmation.

4.4 Special requests including dietary requirements, medical conditions, or mobility limitations shall be binding only if recorded in writing in the final booking documentation.

5. PRICE GUARANTEE AND PAYMENT TERMS

5.1 Price Guarantee

5.1.1 Upon confirmation of a Booking and receipt of the required deposit, Safari-tz.com("the Company") guarantees to honour the prices for each individual item specified in the confirmed Quotation, subject to the provisions set out below.

5.1.2 Estimated Price Increases. Where a Booking is made for a travel period for which final Supplier rates are not yet published, the Company may include an estimated increase within the Quotation. Such estimate is based on anticipated Supplier adjustments. The Client acknowledges and agrees that actual Supplier pricing may differ from the estimate at the time final payment becomes due. The Client shall be responsible for payment of any such confirmed increase, provided that such increase shall not exceed twice the originally estimated amount included in the Quotation.

5.1.3 Government-Regulated Fees and Taxes. The Client acknowledges that the tourism sector in Tanzania is subject to regulatory changes, including but not limited to national park entry fees, conservation levies, tourism taxes, and statutory charges. Where such fees are increased, introduced, or amended by governmental or regulatory authorities after the issuance of the Quotation, the Client shall be responsible for payment of the additional amount.

5.1.4 Fuel Surcharges. In circumstances where fuel costs materially increase and Suppliers impose fuel surcharges on the Company, such additional charges shall be payable by the Client.

5.1.5 Major Pricing Errors. In the event that the Company identifies a material or obvious pricing error in a Quotation that results in a significant undercharge, the Company reserves the right to withdraw, amend, or reissue the Quotation prior to final payment. If such an error is discovered after deposit but before final payment, the Client shall be notified promptly and provided the opportunity to accept the corrected price or cancel the Booking with a full refund of the deposit paid.

5.1.6 Exchange Rate Fluctuations. Where Suppliers impose exchange rate surcharges due to substantial fluctuations in international currency markets after the date of Quotation, and such surcharge is passed to the Company, the Client shall be responsible for payment of the additional amount.

5.2 Payment Terms

5.2.1 Deposit Requirements. The required deposit shall be payable upon confirmation of Booking as follows:

5.2.1.1 Camping safari bookings require a ten percent (10%) deposit of the total Booking value.

5.2.1.2 Lodge safari bookings require a forty percent (40%) deposit of the total Booking value.

5.2.1.3 Tailor-made safari bookings may require a deposit ranging between ten percent (10%) and seventy percent (70%), as specified in the Quotation.

5.2.2 Final Payment. Unless otherwise agreed in writing, all outstanding balances and instalments must be paid in full prior to the commencement of the Tour. Where final payment is agreed to be made upon arrival, such payment must be made in cash in United States Dollars unless otherwise approved by the Company.

5.2.3 Accepted Payment Methods. Payments may be made by bank wire transfer, credit or debit card, or authorised online payment platforms including, but not limited to, PesaPal. The Company shall provide official banking details upon confirmation.

5.2.4 Payment Accounts. All payments must be made exclusively to official Company bank accounts located in the United Republic of Tanzania. The Company does not maintain offshore accounts and shall not be liable for funds transferred to any unauthorised account.

5.2.5 Group Payments. In the case of group Bookings, individual Travellers may remit payments separately; however, all communications regarding payment obligations shall be conducted through the designated Group Leader. The Group Leader remains financially responsible for the full value of the Booking.

5.2.6 Confirmation of Bank Transfers. Where payment is made by bank transfer, the Client shall provide proof of payment by emailing a copy of the bank confirmation or remittance advice to the Company. The Company shall confirm receipt of funds in writing.

5.2.7 Payment Charges and Fees. All costs associated with payment transactions, including but not limited to wire transfer charges, foreign exchange fees, and credit or online payment surcharges (including any applicable three point five percent (3.5%) processing fee), shall be borne solely by the Client.

5.2.8 Non-Payment. Failure to make payment by the stipulated due date may result in cancellation of the Booking, in which case cancellation charges shall apply in accordance with these Terms and Conditions.

6. PRICE ADJUSTMENTS

6.1 Confirmed prices may be adjusted prior to final payment where increases arise from government-imposed fees, park charges, taxes, airline surcharges, exchange rate fluctuations, or Supplier-imposed increases.

6.2 The Client shall be responsible for payment of any such increases.

6.3 In the event of an obvious pricing error, the Company reserves the right to correct or withdraw the affected offer.

7. CANCELLATIONS AND REFUNDS

7.1 All cancellations must be submitted in writing.

7.2 Unless otherwise specified in the confirmation documentation, the following cancellation policy shall apply:

7.2.1 For cancellations sixty-one days or more before departure, deposits are non-refundable.

7.2.2 For cancellations between zero and sixty days prior to departure, one hundred percent of the booking value shall be forfeited.

7.3 The Company shall attempt to recover refundable amounts from Suppliers but does not guarantee waiver of Supplier penalties.

7.4 No refunds shall be granted for no-shows, early departure, or unused portions of Services.

7.5 Approved refunds shall be processed within twenty-one working days, less any applicable transaction charges.

8. CHANGES TO BOOKINGS

5.1 Voluntary changes requested by the Client after confirmation are subject to availability and may incur administrative fees and Supplier penalties.

5.2 In the event of involuntary changes due to Force Majeure, airline schedule alterations, overbooking, or Supplier failure, the Company shall endeavour to provide reasonable alternatives or refund affected Services subject to recovery from Suppliers.

9. TRAVEL DOCUMENTS AND CLIENT RESPONSIBILITY

9.1 The Client is solely responsible for ensuring possession of valid travel documentation including passports with at least six months validity, required visas, vaccination certificates, and other health documentation.

9.2 Travel insurance is mandatory and must include coverage for medical expenses, evacuation, trip cancellation, and baggage loss.

9.3 The Company shall not be liable for losses arising from inadequate documentation or insurance.

10. LIABILITY AND LIMITATION OF LIABILITY

10.1 The Company acts as an agent for Suppliers and does not directly control the delivery of third-party services.

10.2 The Company shall not be liable for injury, illness, death, loss of property, delays, airline disruptions, Supplier failures, or Force Majeure events.

10.3 Participation in safari activities involves inherent risk including wildlife encounters and remote travel conditions, which are accepted by the Client.

10.4 The Company's maximum liability shall be limited to the amount paid by the Client for the specific Booking giving rise to the claim.

10.5 The Company shall not be liable for indirect or consequential losses including visa costs, vaccination costs, or missed onward travel.

11. INTELLECTUAL PROPERTY

11.1 All content on the Website, including text, logos, branding, itineraries, photographs, and graphics, is the exclusive property of Safari-tz Travel & Tours Ltd.

11.2 No reproduction, redistribution, or commercial use is permitted without written consent.

12. PRIVACY AND DATA PROTECTION

12.1 The Company collects personal data necessary for processing bookings and communicating travel information.

12.2 Such data may include names, contact details, passport information, and travel preferences.

12.3 Information shall be shared only with Suppliers as required to fulfil Services and shall not be sold to third parties.

13. FORCE MAJEURE

13.1 The Company shall not be liable for failure to perform contractual obligations where such failure results from Force Majeure.

13.2 Refunds in such cases shall be limited to amounts recovered from Suppliers.

14. DISPUTE RESOLUTION

14.1 Any dispute arising from these Terms shall first be addressed through written communication between the parties.

14.2 If unresolved, the dispute shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania.

14.3 The Courts of Tanzania shall have exclusive jurisdiction.

15. AMENDMENTS

15.1 The Company reserves the right to amend these Terms at any time.

15.2 Amendments shall take effect upon publication on the Website.
